These terms and conditions, which may be amended from time to time, apply to all Activitygift services directly or indirectly made available online, through any device, or by email. By using the Activitygift website or any other platform, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below.
1. Scope and Role of Activitygift
Through the website www.activitygift.com, we (Activitygift and its affiliate (distribution) partners) provide an online platform through which bookings can be made for activities.
From the point at which you make your booking, Activitygift acts solely as an intermediary between you and the activity provider, on behalf of the accommodation provider, as Activitygift does not sell activities under its own name. Activitygift transmits the details of your booking to the relevant activity provider and sends you a confirmation email on behalf of the provider.
Activitygift is responsible for the transaction process on www.activitygift.com. As such, Activitygift manages transaction disputes should payment process issues occur. In addition, if there are any questions, remarks or complaints about the transaction, please contact us directly.
2. Reliance on Third Party Information and Services
When rendering our services, the information that we disclose is based on the information provided to us by activity providers. Although we will use reasonable skill and care in performing our services, we will not verify if, and cannot guarantee that, all information is accurate, complete, or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any temporary and/or partial breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information, or non-delivery of information.
3. Privacy and Cookies
The privacy of all Activitygift users is respected. As a gift card user, you can rest assured that no gift card usage data of any kind is shared with anyone else, neither on an individual basis (i.e. one gift card) nor on an anonymized aggregated basis (i.e. multiple gift cards). For more information, please see Privacy & Cookies in the footer of the Activitygift website.
4. Payment and Prices
Payments are immediately due when ordering. Payments can be made by Visa, MasterCard, PayPal, and available local payment methods. All Activitygift payment processes are properly secured. Payments (pending) cannot be amended or cancelled. The processing of gift card transactions requires 24 hours. As such, the purchased gift card code can be redeemed after 24 hours.
All activity prices on www.activitygift.com are displayed including VAT and other taxes, unless stated differently on our website or the confirmation email. The gift cards of Activitygift are out of scope of VAT.
Business orders are generally settled by invoice payment. Orders to be paid via invoice are sent within two business days. Please note that the Activitygifts will only be activated once the order payment has been made. Please contact us for questions or special requests.
5. Cancellation of a Gift Order
All Activitygift value codes are bearer instruments. As Activitygift value codes can be duplicated or shared with third parties after the sale, and hence be redeemed by any third party, order cancellation is not possible.
6. Validity of an Activitygift
All Activitygifts are valid for two years after purchase.
Activitygift reserves the right to block / deactivate any Activitygift of which the payment has been cancelled or not received in any way. In case one or more bookings have been made with an Activitygift that has not been paid for fully, Activitygift reserves the right to cancel these bookings.
7. Redeem an Activitygift
Activitygifts are redeemable for all activities that show availability at www.activitygift.com at your selected dates and location. It is not possible to make your booking and redeem your Activitygift directly with the provider. When making a booking at www.activitygift.com, the Activitygift value will be deducted from the amount payable. If the Activitygift is not used in full at once, the remainder stays valid for another booking. If the booking is more expensive than the Activitygift, the remainder can be paid for by online payment. One Activitygift can be used per booking.
After the payment and/or redemption of the Activitygift, you will receive the booking confirmation via email. You can then print this booking confirmation and show it upon arrival. Make sure to have your identification with you.
It is not possible to redeem your Activitygift for funds or cash payment.
8. Cancel or Modify a Booking
If you wish to cancel your reservation, please contact us at [email protected]. Please note that you may be charged for your cancellation in accordance with the relevant activity’s cancellation and no-show policy. We recommend that you read the cancellation and no-show policy of the booked activity carefully prior to making your reservation. You must attend the activity at the day and time provided for in your booking confirmation.
Provider initiated activity cancellations are rare. If they do occur, then they generally lead to a full refund of the ticket price. If your activity is cancelled, please contact us at [email protected]. Please note that any refund procedure can take up to 30 days from the moment that the activity has been cancelled. All refunds are loaded on the gift card that was used to make the booking.
If you wish to modify your reservation, this is at the discretion of the activity provider. Contact us at [email protected] with your booking code and we’d be happy to look into the possibilities for modifying your booking. Please select your tour carefully, as not all travel service providers will accept changes once you’ve received confirmation of your booking.
In the case of a no-show (i.e. remaining absent from the booked activity), there will be no refund. We recommend that you read the cancellation and no-show policy of the relevant Supplier carefully prior to making your reservation.
9. Activity Complaints
Activitygift is not liable for any claims or complaints about the activity.
10. Further Correspondence
By completing a booking or by ordering an Activitygift, you agree to receive (i) an email that we may send to you prior to your arrival date with information on your destination and reservation and (ii) an email which we may send to you after your trip or Activitygift order inviting you to complete a feedback form.
11. Intellectual Property
Unless stated otherwise, the intellectual property rights (including the copyrights) of the content, material, and information on this website is property of Activitygift. Without Activitygift’s written consent, no part of this website may be used or reproduced.
Subject to the limitations set out in these terms and conditions and to the extent permitted by law, Activitygift shall not be held liable for (i) any punitive, special, direct, or indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability, and ratings) of the activity as made available on our website, (iii) the services rendered, or the products offered by the activity provider, (iv) any (direct, indirect, consequential or punitive) damages, losses, or costs suffered, incurred, or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential, or punitive) damages, losses, or costs suffered, incurred, or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the activity (its employees, directors, officers, agents, representatives, or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure, or any other event beyond our control.
